The Program on = Corporations, Law=20 & Democracy (POCLAD) posted a =93Model Legal Brief to = Eliminate=20 Corporate Rights=94 to its website on October 10, making it = available=20 to help citizen groups create winning organizing strategies = by=20 stripping constitutional protections from corporations and=20 preventing them from governing their communities. =

Richard=20 Grossman, co-founder of POCLAD, authored the brief with = Thomas=20 Linzey, Esq., director of the Community Environmental Legal = Defense=20 Fund, (CELDF) a public interest law firm in Chambersburg,=20 Pennsylvania, and Dan Brannen, a Santa Fe attorney. =

The=20 Brief was created to support community leaders and citizens = across=20 the United States who are confronting the array of = judicially=20 bestowed constitutional rights wielded by corporations. The = Brief=20 not only challenges =93corporate personhood=94 =96 the = theory that=20 corporations possess the constitutional rights of people and = therefore may use the Bill of Rights to get courts and = police to=20 deny people=92s fundamental rights, but also confronts the = powers=20 corporations wield under the Commerce and Contracts Clauses = of the=20 U.S. Constitution.

Grossman, of Milton Mills, New = Hampshire,=20 has written extensively on corporate and legal history. He = pointed=20 out that, =93this brief is intended to assist communities = challenging=20 the U.S. government=92s gift of constitutional powers to = property=20 organized as corporations. Accordingly, it is NOT about = corporate=20 responsibility, corporate ethics, corporate codes of = conduct, good=20 corporate =91citizenship,=92 corporate crime, corporate = reform, consumer=20 protection, stakeholders, or fixing regulatory agencies.=94=20

The Brief contains a history showing how federal = courts=20 gradually granted more Bill of Rights protections to = corporations=20 over the past 150 years. It finds that =93corporations = regularly and=20 illegitimately deny the people their inalienable rights,=94 = and=20 concludes that such denials =93are beyond the authority of = the=20 corporation to exercise=85beyond the authority of the = Courts, or any=20 other branches of government, to confer=85(and deny) the = people their=20 ability to govern themselves.=94
